    A federal appeals court is set to consider the case of three students who were sent home from a Northern California high school for refusing to remove shirts emblazoned with the American flag on Cinco de Mayo.

    On Thursday the 9th U.S. Circuit Court of Appeals in San Francisco will hear oral arguments after a lower court tossed out the case in 2011.

    School officials argued that students' civil rights can be curtailed to ensure safety and limit disruptions. The lower court agreed and the students appealed.

    The students wore the shirts on May 5, 2010. Mexicans celebrate that day as "Cinco de Mayo," and compare it to the United States' July Fourth observance. Unpleasant verbal exchanges and altercations marked the previous year's celebrations at Live Oak High School in Morgan Hill, 20 miles south of San Jose.

    Being contrary should be protected speech. It was wrong to do what was done. I grew up 40 miles north of there btw.

      Seems like the kid was sent home for trolling... not for wearing a shirt.

      Also, schools need to lighten up.

      and... just because something is a "right" doesn't mean it's not wrong.

          I got sent home lots of times for trolling.

          High school is such bull****. It's also completely meaningless. I wish I was a motivational speaker so I could tell kids to blow that **** off. We'd probably cut down on teenage suicide rates.

              Cinco de Mayo celebrates a victory over the French. So A) there's no reason to celebrate, and B) the US was preoccupied and not a party to the conflict.

              Isn't wearing the American flag considered disrespectful according to the flag code?

                          Because its wholly unnecessary to do so on a day where a lot of other people celebrate another day important to people of another country, a country they originated from or their parents did, much to the chagrin of nationalist and cranks everywhere.

                          They didnt do this because they thing America is so grand and gee what a coincidence, it happens to be this other day of celebration and commemoration. No, they did it to be contrarian and get a rise. No big deal in my eyes but I'm not so obtuse that I cant see why some people's feathers were ruffled. Aren't you old enough to figure out other perspectives that arent your own yet?

                            Actually, does anyone know is that really extends to all images of the flag, or is it referring to an actual physical flag being used as clothing? If the former, we have to deal with the image of every Congressman and the President wearing flag lapel pins to avoid being called unpatriotic.

                              Perhaps they were merely trying to remind those of Mexican heritage exactly what country they choose to live in and enjoy the benefits thereof?
