North Carolina May Declare Official State Religion Under New Bill
Republican North Carolina state legislators have proposed allowing an official state religion in a measure that would declare the state exempt from the Constitution and court rulings.
The bill, filed Monday by two GOP lawmakers from Rowan County and backed by nine other Republicans, says each state "is sovereign" and courts cannot block a state "from making laws respecting an establishment of religion." The legislation was filed in response to a lawsuit to stop county commissioners in Rowan County from opening meetings with a Christian prayer, wral.com reported.
The religion bill comes as some Republican-led states seek to separate themselves from the federal government, primarily on the issues of guns and Obamacare. This includes a proposal in Mississippi to establish a state board with the power to nullify federal laws.
The North Carolina bill's main sponsors, state Reps. Carl Ford (R-China Grove) and Harry Warren (R-Salisbury), could not be reached for comment on Tuesday, The Salisbury Post reported. Co-sponsors include House Majority Leader Edgar Starnes (R-Hickory). Another is state Rep. Larry Pittman (R-Concord), who in February introduced a state constitutional amendment that would allow for carrying concealed weapons to fight federal "tyranny."
The bill says the First Amendment only applies to the federal government and does not stop state governments, local governments and school districts from adopting measures that defy the Constitution. The legislation also says that the Tenth Amendment, which says powers not reserved for the federal government belong to the states, prohibits court rulings that would seek to apply the First Amendment to state and local officials.
The bill reads:
SECTION 1. The North Carolina General Assembly asserts that the Constitution of the United States of America does not prohibit states or their subsidiaries from making laws respecting an establishment of religion.
SECTION 2. The North Carolina General Assembly does not recognize federal court rulings which prohibit and otherwise regulate the State of North Carolina, its public schools, or any political subdivisions of the State from making laws respecting an establishment of religion.

I think it's still fair game to make fun of idiots. Not fair to translate that to the rest of the party, of course, unless this is a sign of where the rest of the party is going... but fortunately I'm confident that only one wing of the Republican party would favor this. Consider that the Republican Party can be seen as having three wings; the Economic wing, with folks like Mitt Romney, the Christian wing, with folks like John Edwards, and the NRA wing, with most of Texas and the West. Two of those three are staunch defenders of the constitution all of the time; the other would happily modify it in this fashion. But the West would prevent the Christian wing from accomplishing this.
(This is not to say that members of all three wings might not be Christian - but members of the Christian wing primarily vote based on their faith. Imagine having two candidates available to vote for; one that is pro-life and against gay marriage, supports prayer in schools, but also supports some gun control. The other doesn't give a rats **** about any of that other stuff, but wants to repeal all gun control. Which one you vote for says which wing you're in.)

I only know so much about the US Constitution, and nothing about the North Carolina Constitution, but based on what I've quickly pulled up.... this seems Constitutional to me? Please someone correct me if I'm wrong, but I only found that Congress couldn't mandate a religion, nothing about the states.
In general, the states are bound by the constitution as well. In specific, the 14th amendment has been read to selectively incorporate some of the provisions of the bill of rights, including the first amendment specifically, as inherent rights of citizens and thus binding the states.

Though I think it is more worthy to be laughed at than other silly bills introduced because the NC House Majority Leader has signed on as a co-signer.
