Since she survived, she was clearly viable at the time the procedure was done. Hence at all times during that procedure, she was more than a "fetus outside the womb."

Under what conditions? I'm sure the "pro-life" crowd gets off on that, pray for a few little departed souls so you can use outlier examples in a crusade to eliminate all abortions. If the "pro-life" movement wasn't as hypocritical as it is, it probably could have eliminated late-term abortions except when the woman's life is in danger or other severe health hazard (e.g. likelihood of permanent disability). Roe v. Wade allows the states to restrict late-term abortions. It's a failure of your movement that that hasn't been accomplished. I don't know any pro-choice people who support unrestricted abortion on demand right up to the point of childbirth.

And, BTW, since this guy is charged with capital murder for performing illegal late term abortions, it would seem their performance is clearly subject to legal restriction.
