    Seeing someone who you know banged your wife would not usually qualify as "heat of passion." You pretty much need to walk in on them banging to have that defense. So, as a prosecutor, I would probably go with second degree murder -- it'd be too tough to argue premeditation, but not too tough to argue away voluntary manslaughter.

      I feel sorry for the victim, but if I was doing door-to-door sales and came upon a house with three visible no soliciting/no trespassing signs, I think I would skip that house.

      One sign = I'm a little annoyed by people knocking at my door.
      Two or more signs = run idiot. The mofo is mayor of crazy town.

        I just checked, and in Florida, premeditation is a tougher standard than normal. It requires not only clear intent to kill, but time to "reflect" on the act and its probable results. The killer must have a "fully formed conscience" intent on killing at the time of the act.

        So, the prosecutors just didn't want to have to go down that road.

              I just noticed the guy had three signs. Still don't think you can use it, but it's a little more interesting. What you really want is a sign that says "IS THERE LIFE AFTER DEATH? COME ON TO MY PROPERTY AND FIND OUT" or even better, "I HAVE A FULLY FORMED CONSCIENCE TO MURDER YOU IF YOU STEP ONTO MY PROPERTY."

                    I would hope this hero is given a congessional medal for his defense of his home! If a person is on your property, shoot them dead. If they are still breathing, keep shooting. That's the American way! If you are in a gated community, and they are near your property but of the wrong race/orientation/religion you should hunt them down, provoke them and shoot them dead to save your neighbors. That is heroism. That is the American way! GOD BLESS AMERICA, MY HOME SWEET HOME (and I have the right to shoot you if you come near it!)
