Realistically, there's probably tens of millions of people alive right now that are smarter than him. There are 70 million people who are 99th percentile IQ, after all.

At a certain point tests do not accurately measure intelligence and the only measurement which is reasonable is achievement.

1) I have no idea what you even mean by accurate measurement. The problem is one of definition
2) very high levels of intelligence are precisely where achievement is the worst as a yardstick of intelligence. Write down the simplest bivariate model you can think of and that will become apparent to you.
The highly intelligent are expected demonstrated genius.
If one person demonstrates genius in many ways or in a greater way than another, I will not not say that the one is necessarily more intelligent than the other.
But if one person demonstrates genius and another scores higher on a test but does not demonstrate genius, I will say that the one who demonstrates genius is more intelligent.
If you want to call that a definition, sure, but I think that 'test taking skill' is not a good demonstration of intelligence nor a good definition of intelligence.

If you disagree about what a reasonable definition is, OK. If your definition is significantly different than mine then I disagree, but what do you think intelligence is and how do you propose to identify it?

Yes, but if you're smarter than 99 percent of the population (but not more), by definition you must have about one percent of the population for company. No? Maybe that 99th percentile ranges from 150 to 300 on the IQ scale, but it's got to be one percent of the population, ie 70 million. Or does 99th percentile mean something else?
As I understand it, being in the 99th percentile IQ-wise means that 99% of the area of the normal curve representing IQ is to the left of you, which does not correspond to 99% of the population.
