          Brown v. Board isn't the gold standard for good supreme court decisions. It was simply an important one for reversing one of the worst decisions in Supreme Court history.

              I would argue that Plessy v. Ferguson is actually far more accurate if you want to go with a non-legislating from the bench position. Equal Protection doesn't necessarily mean everyone has to learn together - they just must be provided equal accomadations. It's why I like trucking out Brown for those anti-legislate from the bench types because that's exactly what the Court did there.

                            No, that's just wrong. The constitutional justification for not being able to secede is flimsy at best. Abraham Lincoln trampled all over the constitution with abandon. The world is a better place for it, but don't pretend that there was any clarity in the issue whatsoever. The reason the South couldn't secede was not the Constitution, but the superior industrial base of the North as well as the North's willingness to fight to preserve the Union.
