        I think the best solution is to have some States with legal gay marriage and abortion, and some states in which it is ilegal, something like The religion of the Prince is the religion of the Kingdom deal in the HRE because of protestantism, if you don't like the rules of your State move to another one that shares your ideas.

                    Having court switching arguments/decisions with "we think it is self evident" in a 10-20 year time shows that it is not self evident and is weak.

                    Having legislators switching arguments/decisions with "we think this is the way the country should run" in a 10-20 year time is what they are there for and is strong.

                    African-Americans did not get their freedom from the courts. And if they did, it would have been a lot weaker. They got their freedom from lawmakers. It is the law not because it was 'self evident', and it was that law which made later decisions "self evident". If a court made a bad decision (because it was 'self evident'), later ones could go back to the law.

                    Legislating from the court just allows the court to make up whatever law it wishes.

                      Exactly the laws are already there. We don't have specific laws just for African-Americans and we don't need specific laws for gays.

                      The legislation argument simply gives the opportunity for one party to oppress the rights of another, which is exactly what we are seeing with Prop 8 and other such "laws."

                        What is oppression and what is not is not 'self evident' unless it is based on law.

                        Many euros would say that the US system without a good safety net/health care is oppression. I can understand their position, and favor it, but I would be up in arms if the Supreme Court made such a ruling.
