    It amused me how cheap gas was in New Jersey compared to Manhattan. The clump of gas stations right outside of the tunnels also.

      Insurance. Specifically, long-tail environmental claims.
      This particular claim appears to go back to at least 1989... which makes it reasonably young, actually. Wezil: I know roughly diddly squat about this claim at this point. All I know is that somebody found evidence of a leak at the site, that the tanks were removed in '89, and the testing appears to have been done b/c of a leak at the neighbor's place... NJDEP is no doubt involved. The owner won't be "charged" per se. Identified as a potentially responsible party would be more correct.

      I am into teh law in that the law has a lot to say about insurance coverage. I'm not a lawyer, but of course we have a cadre of them.

          The costs on such a claim must be huge. Would this sort of thing be paid by insurance and if so, I assume you go after the former sire owner (responsible party) for the costs? Perhaps the supplier of the fuel?

            Saw the web page for the Far Niente Restaurant, and noticed there is a Far Niente Ristorante in Glendale, California. And yes, they serve Far Niente wine.

                Asher - hah. No, honestly. Even if we thought such a system was a good idea, or right, man would we get reamed for it in court.

                Wezil - the costs can indeed get big. It varies quite a bit. In this case, the only info I have says soil contamination... if it hasn't hit the groundwater, the price tag shouldn't be too bad. Then you pretty much just dig it out and send it to a haz waste facility. Of course, they probably just haven't tested the gw yet.

                As for coverage... well, that's complicated...

                You've got your facts of the matter.
                You've got your policy language.
                And then you've got New Jersey insurance law regarding said policy language, which may totally change what the policy means.

                NJ's high court has said some interesting things about the pollution exclusion commonly used in commerical liability policies between 1970 and 1986. Short version: you tricked us (or rather our insurance commish)! It doesn't mean what it says. It means this other (much less restrictive) thing.

                It seems I may be hunting for a 1986/87 policy... which, if it was issued at all, is likely to contain an exclusion they haven't shredded. But we shall see. I've yet to do the policy research.

                As regards who one goes after...

                1) Current site owner
                2) Former owners, if any (if available)
                3) Distributor, and possibly up the food chain to the big boys.
                4) Insurance (insurers of all PRPs). Sometimes (rarely in small business situations) people bought special environmental insurance. Those policies tend to be claims-made policies, though, so the timing has to be just right.

                Funds might also be available through the tank fund or, in some cases, from a redevelopment grant (brownfield), or in the really big ones, the USEPA might chip in a bunch of dough. That won't happen here, though.

                          You can say a lot of things about hockey players, but wimpy pansies is not one of them. These are the people who get their teeth knocked out and continue playing, or when they require 12 stitches to the forehead the doctors need to order them to wait the 3-4 mins while they get stitched before returning to the ice.

                          Most hockey players are far short of a full set of teeth.

                          Something the English would know about, but not from sport.
