Also, firing someone for participating in porn is the utmost ridiculousy. People who do porn usually do it whent hey have no other way to make money. So you have someone who is trying to rebuild himself and attempting to earn money in normal fashion (that the owner prefers over porn), so instead of applauding the worker for coming around, he is fired... only to comeback to porn?

The House of Representatives has two versions of federal law proposals, one covering transgenders and one (ENDA) that does not. The second passed 235yea-184nay-14nv and now we're waiting on the Senate to pass either its own legislation or one of the two already proposed by the House. The two chambers will have to rectify if they have different bills from one another, pass a combined bill, send it to Pres. Bush, he'll veto, and Congress will have to override him. Or Congress could wait until the next president takes office. Many states have laws against employment discrimination based on sexual orientation (us Nevadans for instance, except transgenders) and cases can be made to find illegal discrimination based on the PERCEPTION of sexual orientation, however Missouri (where this happened) does not. If this were a federal government job he was fired from, he'd be protected, but as of yet there is no federal law protecting lgbt employees outside of government work. As for firing based on his side work, that's less clear. The case could be made that he was fired for gay porn, but as Missouri has no protections for lgbt employees...

Case-by-case would be your answer. There are groups not protected, groups that are, groups partially protected. State and federal laws differ and it can be a maddening mess.

Nope and nope. Lgbt persons are one of the last largely unprotected groups in the fabric of US society. That's been changing over the last few years, but still has a ways to go...
