At first glance it seemed to me that Texas was wrong but after reading the explanations by the Supreme Court it seemed to make sense. Thats why we have judges and not people in forums decide complicated legal matters. I doubt the Texans involved were actually aware of this subtlety when they acted as they did. But through the process of judicial review their actions were legal.

Regardless, he's an international war criminal so more than likely he'd be sent to the Hague, unless the US-backed Afghan government wanted claim on him first.

Sloww I didn't quite mean it that way. I meant that I doubt the police agency or DA holding him had the same knowledge of treaties/international law and there intepretations as regards to domestic law.
Calm down - I said you were right.
On a side note - I doubt letting him be in contact with is embassy would have had any effect on the outcome of the trial so I don't know why just a s a mmter of international courtesy and CYA they just didn't let him.
