Bike sex case sparks legal debate

The case has prompted debate and online discussion
The case of a man convicted of simulating sex with his bicycle has sparked a debate about human rights and the privacy of an individual.

Internet message boards have been buzzing with comment about the case of Robert Stewart, 51, from Ayr.

He was reported by cleaners at a hostel who unlocked his door and found him engaged in a sex act with his bike.

Stewart was put on the Sex Offenders' Register, which some posters said was an over-reaction by the sheriff.

Stewart admitted a sexually aggravated breach of the peace by conducting himself in a disorderly manner and simulating sex. As well as being put on register for three years, he was put on probation for the same length of time.

More than a million people have read the story on the BBC news website and it has been hotly debated on forums elsewhere.

One contributor asked: "Would they have done the same to a woman with a sex toy?

"Apart from the fact that the sex toy was manufactured for the purpose, and a bicycle wasn't, I really don't see that the two acts are all that different."

Another blogger said: "I am more disturbed by the sheriff's ruling than the act of having sex with a bike."

Those discussing the case online were also worried about the future implications.

One person wrote: "It's bad news for privacy in the UK because of how a ruling like this could be used to support similar cases in future."

Legal experts said he would have been placed on the Sex Offenders' Register under Section 80 of the Sexual Offences Act 2003.

This states that a person should be put on the register "if the court determines that there was a significant sexual aspect to the offender's behaviour in committing the offence".

This is not the first legal case involving someone simulating sex with an inanimate object.

* In 2002 the same man was arrested for simulating sex with a traffic cone in front of a crowd of people
* Earlier this month, sentence was deferred on teenager Steven Marshall, from Galashiels, who admitted simulating sex on a pavement while drunk.

Human rights lawyer John Scott told the BBC Scotland news website that the case raised important privacy issues.

He said: "It certainly prompts questions about what people can and can't do behind closed doors with inanimate objects.

"However, the difficulty is that the man involved in this case pleaded guilty to a breach of the peace so these issues of privacy weren't considered by the court."

He added: "The sheriff had to act on the guilty plea and make a decision about whether or not there was a sexual nature to the offence. Clearly there was and that's why the man has ended up on the register."

However, Mr Scott said it should not be seen as a test case or one that would set a precedent in the future.

"This case should not prevent people who want to engage in this sort of activity doing so.

"What I would say to a client of mine that wanted to do this kind of thing is as long as it's behind a bolted door, with an inanimate object, then each to their own."

An Australian man and his daughter have asked for understanding after revealing on national TV they have an incestuous relationship, and have a daughter.

John Deaves, 61, appeared on the TV show 60 Minutes with daughter Jenny, 39, and nine-month-old Celeste - to whom he is both father and grandfather.

Last month a judge banned them from having sex with each other and revealed they had a child in 2001 who died.

But they insisted on the programme that they were "normal intellectual adults".

Mr Deaves said they both "had careers, had a normal life like everybody else".

He added: "But [we have] fallen in love with each other when we are biologically related, when we've discovered each other later in life."

Mr Deaves had left the family home when his daughter Jenny was a baby, and did not see her again for 30 years.

When the couple met, in 2000, they began a sexual relationship.

Ms Deaves told 60 Minutes she began to see John as a man first and a father second.

"I was looking at him, sort of going, oh, he's not too bad. Like you might look at a man across the bar at a nightclub," she said.

"John and I are in this relationship as consenting adults. We are just asking for a little bit of respect and understanding."

The couple each pleaded guilty to two charges of incest last month and were banned from having sex with each other.

According to the judge's ruling in the case, the couple had a child in 2001 who died from congenital heart disease shortly after birth.

There's such an angle in the other case as well. Two of their four children are disabled.

I've just heard of another case where two a brother and sister both in their 30's where persecuted for having sex, can't find the linky though may be fake news (a yellow rag is the source)



People need to make up their mind, either they take the silly bronze age god seriusly and persecute homosexuals and people who sleep with their son's wife or they need to stop persecuting adult consenting incestual couples.

The only thing keeping that illegal is the yuck factor, but people forget that homosexuality seemed just as repulsive a century ago. Also I'm pretty sure some people in the 19th century felt just as revolted by misgenation. Its a matter of rights and ethics, the only reason why we let this ilogical bigotry persist is because they are or seem such a tiny minority.

I have no problem with a well constructed argument in favor of Eugenics (and would probably support it) that happens to punish incestus couples since it penalizes everyone who spreads bad genes.


I would also have no problem making it ilegal if humans agreed that the Abrahamic God exists or that at least we as a civilization belive that God exits, but then we need to make homosexuality ilegal too (we may also have to stop eating pork and get circumcised depending if we go Koran/Talmud or if we stick to Christianity)



I have a big problem with people making something ilegal because if feels wrong. WTF is that the way one should determine how to optimise a society? Well if that's the case we should really make sure those pesky Jews convert or else! We should also make sure those gooks don't get too uppity.
