Oerdin, I think at the very least you need to retract your comments about Elizabeth Hill, since she not only is directly attacking the GOP here but that article makes it clear she supports closing the exemption (I will not call it a loophole as it's intentionally made for economic reasons, whether or not it's correct).
Patrokolos, technically yes you are supposed to pay use tax for that (but my understanding is you receive a rebate for the amount of tax you paid already).<Reverend> IRC is just multiplayer notepad.

Here's how the court I work for is battening down the financial hatches.
A few months ago, hundreds of copiers were replaced by newer, more expensive models which work nowhere near as good as the copiers they replaced.
For the past few months, hundreds of computers (including my own) have been replaced with newer, more expensive models which work nowhere near as good as the computers they replaced.
This morning, maintence showed up to patch the crack in the wall we've had since the 1994 Northridge earthquake.
This weekend, one of the offices downstairs is getting all new furniture.
It's the old bureaucratic trick, unnecessarily increase your spending, so that when your agency is cut x%, the cut doesn't effect its operations.
The waste, alas, the waste!

Sales tax, in most states, is payable regardless of where you live, so long as you are physically in the state and the business you are buying from is physically in the state. If you buy over the phone or by mail this does not apply unless that business has a 'presence' in the state you are in, but it does apply in person, no matter where you're 'from'.
In the other direction, if you are from a state and buy an item in a different state, you are subject to 'use tax' in the state you reside in, that is generally equal to the sales tax you would have paid in-state minus any you did pay in the other state (i'm not sure how prevalent that double-tax rebate is). This varies by state on the amount it's on, I believe (say, any purchase >$100), but generally doesn't vary by item, except in that some items are exempted for reasons like this one - economic.
CA might have exempted those who buy from CA retailers but go out-of-state, in order to encourage shopping in their state; or they might have exempted those in CA who buy from out-of-state, to encourage corporations in-state who do business with these things (say, airlines). I'd presume the former more than the latter - hence the 3 month out-of-state period
and it's not good business to encourage your in-state folk to go to Nevada to buy things - but perhaps this is where the 'loophole' element comes from.
Either way, it is definitely an exemption from a normal tax; not a loophole, except in that it is an exemption for a purpose that is being used contra-purpose, but definitely an exemption.<Reverend> IRC is just multiplayer notepad.
