I'll have to agree with you there. Executive Order 13228 of Oct 8th '01 established the Office of Homeland Security. It was Congress (specifically, Sen. Lieberman) who was the first sponsor of a bill on Oct 11th '01 for the Office of Homeland Security be wrapped with other offices into a cabinet-level department (the DHS). The following summer saw a different version of the bill in both chambers and Bush signed it into law in Nov '02. But I don't believe for one second that VP Cheney and other PNAC signatories hadn't been pushing behind the scenes as well.
