            The Supreme court taking up the issue of the constitutionality of lethal injection is big news and some courts have already put a morotorium on new executions till the issue is resolved, considering it is life or death. Thats right, the case is not even decided but only because it is being decided, some courts put a stay on all executions.

            Why? Because the constitutionality of lethal injection is in question and they want to wait till it is decided instead of killing people in an inhumane way.

            Texas responds by putting its fingers in it's ears and saying "la la la la" I can't hear you.

            How would you prefer the death penalty be administered?

                        It's not like it was his first and only appeal. It's nothing but a stalling tactic to try to derail the scheduled execution as close to the expiration of the death warrant as possible, so that there's no way for the state to appeal any stay before expiration of the warrant.

                        If they were that concerned, they could have (a) filed the appeal a day earlier, or (b) had an extra laptop or backed up their filing to a flash drive so they could move it to an extra laptop. They were playing games to get in as late as possible, and they blew it. Too bad.

                          Sure it is. Given the simplicity of an application for a stay of this type, they could have made it very generic, no more than two or three pages plus copied exhibits.

                          They could have made it in advance of the SCOTUS ruling in event of a favorable ruling, then all that would have been needed once SCOTUS ruled was to get the electronic ruling printed off of Westlaw or Nexis or out of the SCOTUS printing office, print and attach it as an exhibit.
