I can see how separation of powers could justify excluding Cheney, but not how it would require excluding him.

I'm not sure that George Washington should set precedent as far as this goes, btw. Sure, he was around when the Constitution was being written, but he really wasn't a part of its formation. He wasn't one of the founders writing long essays about it or hammering out the specifics of the language in the Continential Congress.
