        1) he had sex with another 17 year-old, who was too drunk to say yes or no. Is this actually rape? It's hard to say, but the fact that this may or may not have been rape should not be used to influence the rest of the case in (2).
        Rape.

By virtue of the fact that he wasn't found guilty in a court of law, I suppose. Damn those libruhl brown peoples loving Georgians.

Well if they actually had a videotape of the rape as Patroklos said, he should have been happy to be serving 10 years on a lesser charge. Maybe that's the reason the AG is appealing the ruling.

My wording on the rape part was clumsy I admit, I should have said she didn't say no in the video, and without seeing the video I would have to accept the decision of those who actually saw it (The jury, I hope) in determining if it was rape or not. Either way, if it was rape then he should have been convicted and jailed for that, and if it wasn't then it should have played no part in the outcome of the other case. So either way it's not relevent to the oral sex jailing apart from to determine the character of such a person.

Wow, aren't you in a petulant mood? Just because Oerdin might not have been fair in assuming the race, don't tar me with the same brush. My nod towards a "Christian state" wasn't exactly unfair considering that anti-sodomy laws are generally only on the books in the first place due to religious interference!

I'll have to ask you to use a bit of your own brainpower here I'm afraid: the types of laws that mean this guy got a harsher sentence for oral sex than if he'd actually had sex with the 15 year-old.

Oral sex was considered a crime in GA. as recently as 1998 even between man and wife.

Sodomy laws haven't been on the books since 03.

Under Georgia law, if Mr Wilson had engaged in sexual intercourse with the girl he would have only been charged with a misdemeanour and would have received a much lighter sentence.

Perhaps not. But in this particular instance the crime was aggravated child molestation. Since the crime argued was child molestation no amount of consensual act moral or immoral enters into the equation Christian style or otherwise. Such is the letter of the law as inappropriately worded and as clumsy as it may be.

As one would normally expect it would appear that just as in the Duke rape case prosecuting attorney hubris seems to be the real motive much moreso than any claims of racism or fundy religious bigotry. Prosecutor offered up numerous plea deals as a means to maintain his "win" despite wide spread outrage within the GA populace of the severity of the sentencing.
