It's pretty much a non-issue when the people in question are in no position to refuse. Maybe not from a legal perspective, but from a moral perspective, at least. Most homeless people are in a constant struggle for survival, they need money to eat. Plus some of them have drug problems, or mental illnesses.

Finally, as I said before, these videos encourage contempt for the homeless by using them as fighting animals for entertainment, slapping on the label "bums," etc. If you found a whole gang of black guys who were willing to put on a minstrel show for cash, it'd still be wrong just for the mockery it makes of the group as a whole.

Elok, should people in such a position be given no opportunities, or just opportunities of which you approve? Refusing puts them no worse off than they were before the opportunity was presented, so I fail to see how they're in no position to refuse.

Ah, so it's "giving them an opportunity?" The guy should get a medal for his humanitarian concern.

So if you pay a trivial amount to a homeless bipolar-diagnosed individual who's off his meds at the time he signs the consent, and then he's injured and requires ongoing medical treatment (at taxpayer expense, or simply not given) afterward, while you make millions off the marketing of this sort of bull****, how exactly is that "giving" them an "opportunity?"

Of course it's giving them an opportunity. It doesn't have to be a very good opportunity to be that, and certainly doesn't have to be risk-free. I can give you an opportunity to have a leg amputated to be part of my next (first) sculpture. That doesn't mean you should take it, but it is still giving you an opportunity.

My point isn't that this is good for them or in good taste, but that it's nothing more than an offer they can accept or refuse, and that the decision should be left to the person who bears the costs of accepting or refusing it. The medical situation is a separate issue that doesn't touch the voluntary agreement aspect.

200+ years of American legal doctrine on the meaning of voluntary consent would tend to disagree that it's a separate issue, especially in labor agreements.

The other side of that coin is the whole question of legal capacity to consent, as it appears a fair number of the bumfights "stars" lacked that capacity due to medication, intoxication, mental impairment, and/or all of the above.
