    Anger at German Koran divorce ban
    German politicians and Muslim groups have expressed outrage over the case of a German judge who refused to allow a Muslim woman a quick divorce.

    The woman, a German citizen of Moroccan descent, had asked for an immediate divorce, saying her husband beat her.

    But the female judge ruled that, under the law of the Koran, the woman had not been subject to unacceptable behaviour, the court in Frankfurt said.

    The judge had now been removed from the divorce proceedings, it said.

    She had argued that the couple's Moroccan cultural background meant it was "not unusual" for the husband to physically punish his wife.

    The woman's domestic abuse therefore did not make her case one of exceptional hardship, she claimed.

    When challenged about her ruling, the judge cited a passage from the Koran.

    Shock

    The country's Central Council of Muslims condemned the decision, which it said should be based on German law.

    "The judge should have made a decision based on the German constitution instead of the Koran," spokeswoman Nurhan Soykan said.

    She added that mistreatment and violence were also grounds for divorce in the Islamic world.

    German lawmakers said that Sharia, or traditional Islamic law, had no place in Germany.

    "The legal and moral concepts of Sharia have nothing to do with German jurisprudence," said Wolfgang Bosbach, a lawmaker with the Christian Democrats.

    "One thing must be clear: in Germany only German law applies," he added.
    With or without religion, you would have good people doing good things and evil people doing evil things. But for good people to do evil things, that takes religion.

      Is the judge herself a muslim? I find it hard to believe this was driven by her personal beliefs but I find it hard to believe she did this at all in any event.

            They didn't, but that could be seen as schocking .

                Focusing on the divorce part, as opposed to the obvious outrage. The delay means that she can't get divorced until May rather than now. They've been separated since last May, there is a restraining order on the husband and he is still threatening her - I don't see why this would stop when they are officially divorced.
                One day Canada will rule the world, and then we'll all be sorry.

                    Uh, bad wording, meant applauded the removal of said judge, I'd imagine. And condemned the ruling.

                    It's late, my logic is fuzzy...

                          Failing to follow the law means that person should be removed as a judge. She has proven she is unfit to hold a position of trust enforcing the nation's laws.

                            A spokesman of the court said that she apologizes for her ruling (which she called a 'mistake'), and that she stopped working at the court for now. The States' Department of Justice has initiated an investigation. The case itself has been taken away from her and been given to a new judge.

                              We had a case here a while ago where an African woman had been torturing her daughter with scalding water, given her cold showers and then locking her out on the balcony in freezing weather among other things.
                              Eventually the father had enough and called the police. In court it was decided that while this behavior would normally lead to a long prison sentence, the mother would in this case not be sent to prison because:

                              1. She was raised the same way in her native country.

                              2. Sending her to prison could damage her relationship with her daughter.
