School officials are agents of the state just like police officers. Suspension from school is a less severe penalty than being thrown in jail, but that doesn't matter. If a police officer gave you a $20 ticket for saying something he found objectionable that officer is still violating your rights. The degree of penalty doesn't matter.

I guess I just don't see that being suspended from school is a violation of one's right to free speech. If one sits in class and talks nonstop to disrupt the class, one may be suspended. Is that a violation of your right to free speech? An agent of the state (teacher) sends you to the principal's office where the principle (also an agent of the state) punished you by suspending you.
In other words, if this is deemed a violation of the 1st amendment, then how can teachers/administrators maintain ANY control over their schools whatsoever?

In my example it's not shouting "fart" that's important, it's continuing to do it despite knowing damn well that you are not supposed to. Schools have the power to regulate the conduct of students. The school wasn't keeping him from blathering about bong hits for Jesus to his stupid friends on his own time, just from holding up an obnoxious banner to embarrass the school during a public event. If it comes to that, he would also not be allowed to hold up such a banner during class while the teacher was lecturing, ...
Perhaps so.

Displaying a nonsensical banner to provoke a reaction from the school administration during a field trip doesn't rise to the level of speech or any other protected activity under the First Amendment. It's nothing but a half-assed prank.

I'd imagine that the banner, even though the student was doing it for fun, articulates the need to revisit the country's drug policy.
