    Being about a swede, I guess the they both have a wood stove wich is way more poisinous

    Drag that whiner out in a backyard and let a firing squad solve the problem.

      I think it depends on how big the garden is, was the smoker close to the fence and what are the air-movement patters in this neighbourhood.

            I refuse to believe that whiffs of smoke outside are dangerous. Neigbours could sue each other for car exhaust fumes at this rate. Anti-smoking hysteria has got out of control, and the risks of passive smoking are ridiculously exaggerated.

                A real jerk too. Some of these anti.smoking loonies are way too aggressive. They're just attacking people they don't know. You know, there are lots of mindful smokers who always seek for distance before they light up, as to not bother others. Even outside they might ask if someone minds, and if someone does mind, well they'll just wait for a later occasion. Of course there are jerks as well who don't care.

                I think well, you need to take your neighbour into account so if you can see that there is smoke damage, well maybe you could think of other ways.. but I REALLY doubt there is damage or even real .. I think they're just annoyed because the SEE the smoker and 'look, she smokes', rather than the smoke actually somehow invading their premises, if it's outside. SUre it's possible though.

                But my point is, these *******s are way more disrupting than many smokers. They're just loud jerks, so that bothers me and many others way more than smokers.

                  That sentance alone ought to lost the guy his caught case. He is effectively saying that smoking in the presence of a none smoker should be illegal. Also his clearly biased language (I take it it is similary offensive in Swedish/whatever language originally written in) shows that he is not a particulary tolerant individual.

                  The Lawyer has no right under EU law IIRC to stop people from smoking on their own property...breach of human rights etc, and the right to commit suicide ought to work in this case

                    This is going too far, but I can understand someone's disgust with smoking. The people below us smoke and everytime they go on their patio to smoke we have to shut up all our windows. It's ****ing annoying and I hate walking through public and having to breath in second hand smoke. If you want to kill yourself, go for it, no concern of mine, but don't bring me down with you. So while I'm not a fan of a nanny state, I do have a total hatred for smokers.

                      No offense, but do you go just as crazy when someone starts a car below your flat ? What about the garbage disposal truuck ? I'll bet it's way more poisonous than any fumes from those down under when they lit a ciarette.
