You've lost me. Why should it matter if Emerson lost his case for my point?

Anyway, even in that case, the court was dealing with a handgun, not a tank or howitzer.
You're argueing irrelevent points. Even the 1st Amendment which I'd hope you'd agree is an individual right has certain limitations placed upon it. Why should it be any different for the 2nd.

        • Not entirely sure what you guys are *****slapping about, but you can't apply everyday language to legal texts. Otherwise legal training would be largely unnecessary.

200 years of federal gun laws? really? DC guns laws originated in 1975. I'm hard pressed to say how the interpretation was established before that.

In fact from 1791 until 1905 2nd ammendment interpretations were in favor of reading the amendment as if it were strictly an individual right. Only after Salina v. Blaksley 1905 did the whole question of collective intent start to find favor in the courts. Since that time numerous rulings have gone both ways. To say an interpretation has been established is just not so.

Note again, the fizzotroll doesnt merely say the 2nd amendment calls for an individual right, he says it calls for an unlimited individual right. Not limited to militia type weapons(say infantry weapons), but applicable to ANY weapon.

                    • From what does the "fizzo" derive?
I came upon a barroom full of bad Salon pictures in which men with hats on the backs of their heads were wolfing food from a counter. It was the institution of the "free lunch" I had struck. You paid for a drink and got as much as you wanted to eat. For something less than a rupee a day a man can feed himself sumptuously in San Francisco, even though he be a bankrupt. Remember this if ever you are stranded in these parts. ~ Rudyard Kipling, 1891
