Is it a fraud if you never intend to make a financial (or other) gain, but intend to commit them a financial injury through deception? Or conversely does theft require you to have received benefit from your actions.

I'm interested in the distinction between fraud and theft (if there is one) other than the act of deception. I should know this, working at the Serious Farce Office, but I'm not on the lawyers side of things.

theft is usually whe n you take something that isnt yours.

fraud is when you use deception and omission to be given something that isnt yours.

it's not a question of benefit, it's a question of taking or gaining something (either a thing, or a pecuniary advantage), to which you have no right.

put simply, the difference between the two is the act of taking (or appropriation) of the item.

if david had walked in, put the ipod in his pocket and walked out, then he would have committed theft, as it stands he has committed fraud. in the first case he would have dishonestly appropriated the ipod without consent. what he has actually done is obtained the item with the consent of the store, but has done so through his dishonesty.

if he had done this here, he would of committed an offence of obtaining property by deception, which as aside, is found in the theft act.

Nice thread. Everyone jumping on and bashing one guy. Just the way I like it. Spitting from the ivory towers, the perfect beings, who are licensed character assassins. It's good none of you have ever done anything, or at least nothing that tops returning an item worth less than 200 dollars and getting a new one in replace. Keep on trashing, no need to stop.

But I bet some of the people who are bashing here are much worse, have performed worse, but who cares. It's the sheep mentality here that got Jesus killed in the first place.
