It could be reasonably argued that sentences which are waaaaaayyyyyyy disproportionate to the crime/amount of harm caused constitution cruel & unusual punishment. I'd say this is a clear case of the punishment not fitting the "crime" and it is so unjust that it is indeed cruel.

And any such argument would be a good deal weaker than one based on an explicit breach of, for instance, 1st Amendment rights. Thus my statement that such a right wasn't quite as strong.

Listen, everyone likes talking about how judges should be activist when they see something that they consider to be a violation of justice. They want the judge to flout the law and "do the right thing" and listen to his heart and sense of justice. The problem is when some conservative Christian listens to his heart and decides federal laws and decisions on abortion are wrong and abortion doctors deserve to be jailed. It is alright for judges to be activist when they are on your side, but it doesn't apply for the "other" side. The problem is that once you open the bag of worms everyone comes on through.

Most enlightened states have exemptions to their statutory rape laws for boys who are just a couple of years older than the girl. Obviously, Georgia is not one of them.

But just to clarify something, does anyone have a problem if some old geezer got 10 years for sweet talking a 15-year-old girl into giving him oral sex? I certainly don't.

id like to know how any one found out abou this as far as the adults were involved i am almost sure no one witnessed this event besides the two involved in it. And then i dont even see any thing from the parents of either kid.

The prosecution star witness admitted her self she was able and willing why is it the boy is in prision?

The kid was a dumb ass and video taped her giving him a BJ. Reportedly the tape was found in his house and it was based on this tape, along with the girl's testimony, that the BJ was indeed consentual.
