The Constitution in question isn't Georgia's but is the Federal Constitution. There are already contradictory rulings (California says it does violate equal protection, Georgia says it doesn't) so it looks like the SCotUS will have to sort it out.Try http://wordforge.net/index.php for discussion and debate.

LotM, can you see why a bright line leads to injustice? We need the flexibility of rebuttable presumptions instead; with the court being the final arbitor of justice through flexible sentencing.

How about we just drop things like laws against theft, murder, kidnapping, speeding, etc, and we just ask that everyone behave ethically, and then you make the court the final arbitor of justice?
People need bright lines, cause they kinda need to know what theyre liable for. If the person who has sexual intercourse with a minor is 21 or over, it's a felony. If he's less than 3 years older, it's a misdemeanor. And if he's more than 3 years old but not yet 21, it's wobbler; it could be a felony or it could be a misdemeanor.
