    • Erm, was that directed at me? If it was, I'm saying that the first NON-smoker that goes into a smokers' bar (per special exemption to anti-smoking laws) and decides he or she wants to sue claiming discrimination or whatever will likely get that special exemption ruled unconstitutional by a state Supreme Court. Not the other way around: Overturning anti-smoking laws.

You are absolutely right. The problem is that the government has taken away so many of our rights (not priveledges but rights) that instead of trying to stop them when they try and do it again we either give in or argue whether it makes sense.

The Constitution grants property rights and Freedom of Association. ITS THAT SIMPLE.

              • This thread is well over 500 posts, but just to chip in: I don't think smoking anything should be legal at all. If you insist on ingesting nicotine, or any other substance, there are other methods of delivery. Chew Nicorette for all I care. Arguing for a right to pollute the air is absurd.

Thats obvious or we wouldn't be having this debate. This post was about someone complaining about a law.

As a non-smoker I would rather be inconvenienced than trample on yet another right for my convenience.

Majority in this instance is irrelevant. Rights belong equally to the minority and majority. Majorities aren't supposed to be allowed to take away the rights of a minority just because it is convenient for the majority. Unfortunately, we have fogotten that quite often along the way.

I'm sure you do nothing at all that pollutes.

                    • Cars are being made that pollute less or not at all, manufacturing processes that can create them and many other things are improving as well, electricity can be made without fossil fuels, modern farms are changing to be more eco-friendly. Just to name a few.

Smoking just pollutes and makes smokers look suicidal.

Thanks for pointing out there are instances when things went wrong. So what's your point? That we should continue to give up rights because of some bad precedents.

                          • Smoking isn't a civil liberty. Just like driving isn't either. Or being a prostitute (in the states that outlaw it) Neither is smoking any illegal drug. Its a lifestyle choice that the government can regulate because of its effects on other people who do not participate in your choice to pollute your lungs.

The comparison to pollution thats a necessary byproduct of the way the world is structured today is retarded.

All this thread has done, is prove that people with addictions cannot be reasonable about any topic in regards to their addiction.

arent you basing your whole arguement on precedent of smokers being allowed to do so in bars?
