          When we captured enemy troops on the field of battle in past wars, they werent extended habeus corpus. We could just go ahead and issues a formal DOW, and call them EPW's, except that then we wouldnt be able to interrogate them, etc.
          This isn't war. Several detainees at Guantanamo have proven to be innocent. Unfortunately, it seems that this captured on the field of battle can actually mean bought for a $5000 from unscrupulous Pakistani bounty hunters. Given this, I don't see how denying these people the ability to challenge their status can possibly be a good thing. And well... torture....

          I sympathize with the poor guy who was at a radical madrassah in Pakistan in September 2001, but who really wasnt an AQ supporter, and got swept up. We should be more careful, cause of the hearts and minds struggle we're in. But I fail to see how such errors and abuses, bad as they are, will lead to the US becoming a bananna republic.
          You fail to see how arresting innocent people and locking them up indefinitely with no promise of a fair trial is going to undermine the rule of law in the country?

          This to me only reemphasizes the importance of a change in the executive in 2008 - to a Dem, or a Republican whose been independent of the admin. So that someone else will have to deal with the difficult security issues facing us, which are REAL, not fearmongering
          I have no such faith in the American political system. This system gave us Bush twice. It will give us some other ****** again in the future. Giving that much power to one man of dubious scruples is just asking for trouble.

              The populace is stupid, but this proves my point. It's not like Congressmen can only follow the mass hysteria. They have the power to convince people, to change people's minds. Or they can just support the terrorists by fearmongering. They have chosen the latter.

                            Lets not start that debate again here. We simply disagree. I suspect most of the Dems in congress who voted against this bill still consider that we are at war.

                            I didnt say it was a good thing. I said its not the beginning of tyranny. Not every bad thing is the beginning of tyranny, and cheapening our rhetoric is not wise.

                            Its not being done to citizens, so it cant prevent citizens from objecting, speaking out, etc. No, I dont think it can or will change what happens here (which, as Che, points out, has never been perfect anyway)

                              You miss my point. When President McCain, or President Rodham Clinton, or even President Clark or President Gore faces the world situation, while they will undoubtedly modify some Bush policies, they will face all the difficulties of protecting us that Bush faces, and will undoubtedly choose at least some polices that are now denounced as part of a rovian neocon conspiracy. Hopefully then it will then be possible to debate their real merit with less of the conspiracy mongering now taking place.

                              • I didnt say it was a good thing. I said its not the beginning of tyranny. Not every bad thing is the beginning of tyranny, and cheapening our rhetoric is not wise.
                                But here I disagree. I argue that the justice system exists party to correct such mistakes. By not allowing these people to prove their innocence or challenge their guilt, the whole system is undermined.

                                That's very slippery slope we're getting onto. What about that crazy American guy that went to fight for the Taliban? Isn't he an "enemy combatant?" What about all the people at Guantanamo Bay who are citizens of nations allied with the US? Surely, if we are willing to restrict the freedoms of citizens of other western nations, doing the same to US citizens is not far off.

                                And I'm telling you, I don't see it happening. The American people elected Bush twice. I don't think there's a good chance of electing someone sane who will look over everything that Bush did and throw it out. Time will tell.
