HOUSTON - Andrea Yates was found not guilty by reason of insanity Wednesday in her second murder trial for the bathtub drownings of her young children.


Yates, 42, will now be committed to a state mental hospital, with periodic hearings before a judge to determine whether she should be released. An earlier jury had found her guilty of murder, but the verdict was overturned on appeal.

In my opinion any time you kill another person it's murder. Whether it's "justified" or not is another matter...

I'm a strong advocate of capital punishment, in fact I think we should be executing more scumbags than we are now. BUT, I concede that mentally ill murderers are categorically different from those who kill in cold blood. Lock her up for life in an institution.

My reasoning:

Those who deliberately murder, who make an active decision to do so, while being capable of recognizing there are other non-murderous options, should be executed. They've demonstrated a willingness to choose murder as a method of solving a problem or having fun.

Those who murder out of passion or panic, who in a state of high emotion make a bad decision, should be imprisoned. They've demonstrated that they aren't capable of making the right decisions in high-stress situations, so shouldn't be loose in society.

Those who murder due to the fact that their brains are receiving faulty information should be sent to a hospital. As a corollary to this, sane people who kill because of faulty information should not be held to the same standards as the cold-blooded or passion killer, although some punishment may be deemed necessary.

I'm missing nothing. Insane people are not criminally responsible for their actions. They need to be 'locked up' to ensure the safety of the public.

You see it as an 'act' - I don't. Yates is a nutbar from everything I have seen and heard. Rest easy Sloww. She will spend a very long time in custody.
