Ordinary legislation cannot bind the hands of future legislatures. If Congress chooses to pass a law permitting the use of NG troops then it supercedes all previous ordinary legislation on that issue. Posse Comitatus is ordinary legislation, not a treaty obligation or a constitutional right. Should congress so decide they could give the active military the right to police ordinary American citizens. Congressional approval or not, we know these things are arbitrary, kinda like UN Resolutions. Pick and choose according to who has the biggest.
It's sorta like the War Powers Act:
