    I'm worried about an eyeball-to-eyeball confrontation in a court over this. Although an employer usually can't tell you want to do in your private life, I think a court would bend over backwards for a health facility that wants its employees to show up smelling healthy and not unhealthy.

      ok day one of this crap. I have found out that the policy states only the facts of smoking. The smell is being brought up by hard core screwballs that are complaining. I was warned i smell like smoke today and said i need to watch it. How can i do that tuber smokes at home my job is not paying him. Texas is a right to wrok state i know they can fire you for all kinds of reasons. I am under contract and technically dont work for the hospital. i have 5 weeks left on this contract. I will decide if i want to renew if **** gets worse i wont work there i will go somewhere else.
      I am just trying to figure this out, if they dont pay you 24 seven how can they dictate what you can and cant do when ur not being paid.
      Human resources even told me that what i do on my own time is my business they dont care cause i asked about the smell of it. the lady tried to tell me if the staff went around sniffing all the people that woprk there there would no work being done. I think that smokers are being singled out cause its a new policy.

        IMHO they can't

        You can smoke 100 cigs a day off their premises as long as you don't reek of it when you arrive

        Do you wear scrubs? You could leave them in the trunk of your car immediately after washing them and change at work.


        Generally on odour policies-- They need to be balanced. if you go after smokers, you also need to go after colognes, perfumes, BO. Applied reasonably such policies boil down to " Thou shalt not stink". Applied unfiarly , such policies could be a witchhunt

          Weyco, a health company in based in Michigan, has indeed fired workers for just being smokers.

            Is Michigan on of those work at will states. I don't understand US employment law since it seems you can terminate people for no reason in certain states. And if you can do it for no reason, then obviously you can do it for a crappy reason ( subject to humans rights legislation, if any, that applies)

            In Canada you can terminate people "for cause" (no notice) or "wrongfully" (you will have to pay out notice) . In any non-union environment, you can be fired anytime . . . its just a matter opf whether or not you get paid off.

              Yes Michigan is an at will state and that's why they can get away with it. I think the courts supported this position. As a result I believe 9 states have passed laws that prohibit smokers from being fired. Being required to pay a higher proportion of the health care benefits has been upheld. I'm sure the courts will be active on this for awhile yet.

                I really have no problems with companies wanting to charge smokers higher health care rates... but if they are going to do that, to be fair, they should also charge fat people and drinkers more for their healthcare as well

                  Problem is that Tia is at a health care provider. Before Josie was born (before conception even) I was a pack a day smoker, and my doctor told me that the carcinogens are in your clothes, on your breath, etc. So, even if I just didn't smoke around the baby I would still be exposing her to potential harmful chemicals just by having the smell on me.

                  Her employeer is being nice in saying that she can smoke, just don't smell like it when you are at work. Though I have no idea how to do that.

                    Smoke ONLY outside and only on windy days. If winds are less than 20 mph, you need to go cold turkey that day

                      drinkers should get discounts. We all know the health benefits of drinking. Though drinking could also cause unwanted pregnancies, which would be more of a strain on health care costs.
