    How legal Is This

    I found out today that the hospital that i am under contract with is now a non smoking facility. This means employees, visitors and patients are not allowed to smoke on the premises. This is all fine i dont mind the new laws even if i am a smoker. The probelm i have is rumors flying that you cant even smell like u have smoked when you show up for work, and that they have said folks cant smoke on premises they do not own or even in the street close to the hospital. If caught u can be written up and possibly fired. I say look man You cant tell me what i can do when i am not on the clock. And how fair is it if i live with a smoker. I am sure that i will smell like it even if i didnt smoke myself. I dont see as how this hospital can actualy do this.
    Is this legal or not?

      From an uninformed person, I doubt it. Smoking in the premises is rare these days. As long as how many ever feet from entrace is standard.
      As far as your own time, highly doubtful they can mandate that a legal substance can't be used.

        I told one of the adminastrators well ya know i am really offended by ur cologne can i write u up for that?? He looked at me like i was an alien. I mean really there are lots of odors may folks have when they go to work if they are going to single out smoking sont ya think srong smelly colognes and this mornings breakfast should be on that list?

          Slow this isnt in the buliding this on the property. U cant smoke on their property. but they are saying u cant smoke in the street if ur on ur lunch break.

            Well, I dunno if hospitals can do this, but I do know there's sorta precedent elsewhere--in public schools, you can be suspended for behavior you engage in off school hours.

              Makes sense to me and I think it's fine.

              The hospital is just trying to keep a clean overall look - that means no smokers around the vicinity of the Hospital.

                  I can see how a lot of nurses in scrubs taking a walk around the block would come across as riff raff and scumbags. I am sure all u guys would grab ur purse and cower if ya saw some of them
                  I am more concerned about the telling us we cant smell of smoke. Tuber smokes at home and idnt emplyed by this hospital, do i tell him he has to quit? I think they are going overboard and cant force that issue.

                      As for the OP, unless this was a condition of your employment when you were hired I can't see how they think that they can enforce it after the fact.

                          I took a class in community college with a bunch of people going pre med to be nurses. All those soon to be nurses took serious smoke breaks.

                              Ok. Lets put it this way.

                              Is it legal to tell someone working with people to
                              "do something about that b.o. or you're gettig fired"?

                              Wonder if that could hold up in court...?
