That's just the maximum sentence. It is rare that any jail time at all is imposed, especially on the first offense. As I said, he will get a slap on the wrists. Probably a fine and community service.
And who says that? I thought the drug war pushers usually highlighted the jail times for drugs as a deterrent to would-be users.
