After looking around these seem to be the facts in short: a raid on a house in Tikrit was carried out based on intelligence that Saddam Hussein was there, officials announced one of the men captured is "believed to be" Saddam Hussein, and the soldiers who carried out the raid were videotaped smoking cigars, patting each other on the back, taking group pictures, etc. afterwards (which they of course don't do every day), and Iraqis throughout Baghdad have fired celebratory shots into the air (which hasn't happened since Uday and Qusay were killed).
The U.S. military is unwilling to confirm, but Patriotic Union of Kurdistan leader Jalal Talabani said bluntly, "Saddam Hussein was arrested in his hometown of Tikrit," and a representative of the group, Nazam Dabag, later said "I confirm that Saddam has been arrested," both of them being quoted by Iran's state news agency.
More convincingly, Governing Council member Dara Noor al-Din has announced Saddam has been captured, saying that Paul Bremer told her personally, and Governing Council member Nasir Chadarchi said "I have received confirmed news about the arrest of Saddam."

Re trial: Sure, the Iraqis will try him, but the Iraqis count as "we" now. And I can't imagine that the US won't have some, uh, advisors for the trial ("no, we don't think that releasing him and naming him Eternal Emperor of the Middle East would be a satisfactory conclusion to the trial.").

Tony Blair has confirmed that former Iraqi President Saddam Hussein has been captured alive in his home town of Tikrit.
Reports say Saddam was "dug out of a cellar" from a house in a poverty-stricken area during a raid by US forces, backed by Kurdish troops.
It is claimed that DNA tests have been carried out and his identity confirmed.
Saddam was apparently found with a suitcase containing half a million dollars worth of cash.
Ahmad Chalabi, leader of the Iraqi National Congress, has said Saddam will probably be put on trial.
A spokesman for the INC said: "We are 100% sure Saddam has been detained by American forces."
A top Iraqi official said US administrator Paul Bremer called Iraqi leaders by telephone to tell them the news.
The US Defence Department is still refusing to confirm the reports but a press conference has been announced for 12pm GMT.
In Baghdad, a spokeswoman for the US-led operation notified reporters that a "very important" announcement will be made at the press conference. It is not known who the speaker will be.
The news is spreading around Iraq rapidly and hundreds of exultant people have taken to the streets of Kirkuk and Baghdad firing weapons into the air in celebration.

Well I think he has probably been captured some time earlier, it would take some time to perform the DNA test...although if expedited, not as long as you think.
It would be nice to see him go to The Hague...it will be one of the biggest since the WWII bunch to go there.

I've heard you can do some sort of DNA testing in as little as a couple of hours.
(They're saying he was capptured at least ~10 hours ago.)
