That's a pretty dang ridiculous thing to say. The she's a slut defense doesn't work so well anymore, it could even backfire with a jury potentially. Significantly it can't explain away the severe vaginal trama realisticly. If the vaginal trama and tearing from a previously sexual enounter was so severe that she was bleeding substancially when Kobe entered her and re-oppened the tears, it would seem virtually certain that the victim would too sore to have any interest in actually having sex with Kobe at the time of the act. Saying "Yeah I raped her but that vaginal tearing was from someone else" doesn't exactly improve Kobe's situation!

They're saying she had sex with another man the night before and normally the rape shield laws in Colorado would prevent the defense from using the "she's a dirty slut" defense, however, this judge has ruled the rape shield laws don't apply. Why he's done so I don't know.

First of all, you need trial lawyers with actual experience in court.

Eh? The DAs are usually retired and have won thousands of criminal trials. The law professors are a mixed bag. They are like expert journalists in that this is their beat and they keep up to date on everything that happens, but their speculation is less valuable IMO.
