But why do you assume adultery isn't already illegal in Texas and that outlawing adultery would have prevented this from happening? Btw, what would have also prevented this incident from happening was the woman not running over her husband.

I don't see why the law should regulate this. If the couple or one of its members considers the cheating makes the couple meaningless, by all means, let them divorce. But if the couple is able to get over it, I don't see why the law should show its nose in these private business.

actually, it is a crime in some states...not necessarily prosecuted, but still on the books...and...having worked in the legal field now for just shy of 20 years, it does have some influence in divorce proceedings too.

Right and wrong depends on the relationship. Some couples are into that kind of "open" relationship -- why would you make their act illegal?
What's wrong with the current situation, where the wife can divorce or girlfriend can break up with a guy who cheats on her?

In divorce cases Adultery is grounds for one of the partners to recieve a smaller share of common assets. A guy who cheats on his wife often finds the wife with 70% instead of 50%.
I was thinking more along the lines of the victim getting basically everything in the divorce proceedings and the adulteror being fined and having his wages garnished...
