Is/Should being a Nazi in the U.S. be illegal?

    Despite disagreeing vehemently with those policies and the member of my family that died at the hands of Nazi's, I would fight for the Nazi party's right to free-speech. But, mind you, threatening violence is against the law... and should be. They can say what they like, as long as they don't threaten anyone.

      Addition: I wasn´t correct - there were two cases in Germany - the second party declared illegal (in 1952) was a Neonazi party called SRP, which was a direct NSDAP-clone

        AFAIK having an illegal party is (in Germany) more related to your first paragraph - eg. you can´t get public jobs as a member of such a party, the party cannot do anything in public (can´t participate in elections, can´t make demos etc.). It doesn´t mean that all the members end up in jail as political prisoners. The main purpose to declare a party illegal is to make sure that this party can´t participate in the political process anymore, it is not the goal to criminalize every individual member.

          They even just failed to declare the NPD illegal, which shows how difficult it is, if we want to remain based on law and constitution.

              Space05us: Hm, even when they act as a kind of army against the state, but within the state? I mean - would it be possible for Al Quaeda to from a political organization in the US? Think of it like the Irish IRA - which followed (follows?) political and terrorist directions at the same time?

                Well, if the constitution says, that all people are equal, and there is a party, that says, that all Jews and Blacks are scum and need to be exterminated, this party is obviously not based on the same constitution and deserves to be outlawed, or at least to be restricted in the democratic process.

                  If thier organization as a whole was involved in criminal activity they would no longer be taken seriously as a political party and they would come under investigation by the proper authorities. Im not old enough to be familiar with the Black Pride (Panther) movement, but Im pretty sure they are an example of this

                    Well, if the constitution says, that all people are equal, and there is a party, that says, that all Jews and Blacks are scum and need to be exterminated, this party is obviously not based on the same constitution and deserves to be outlawed, or at least to be restricted in the democratic process.
                    if thier motto was kill the jews they most likely wouldnt get elected

                      Hopefully, although there was a precedence in history, where such a party actually got elected. It ended in a disaster and dozen million deads. This has to be prevented from happening again by all means, even if they sound undemocratic.

                            Hopefully, although there was a precedence in history, where such a party actually got elected. It ended in a disaster and dozen million deads. This has to be prevented from happening again by all means, even if they sound undemocratic.
