    Or rather, the UN commitee for Human Rights.

    I've just read this in Le Monde, 27 Apr 2003

    Parodie à l'ONU

    UNE BIEN MAUVAISE publicité a été faite à l'ONU depuis six semaines par la session annuelle de la Commission des droits de l'homme, qui devait s'achever le 26 avril à Genève. La dérive de cette commission, censée exercer une surveillance collective sur la façon dont les Etats respectent les droits de la personne et les libertés fondamentales, devient plus manifeste d'année en année et fournira du grain à moudre à tous ceux qui voudraient jeter le discrédit sur l'ensemble du système onusien.

    Les choses avaient mal commencé, cette année, avec l'aide regrettable de la France, par l'élection malencontreuse à la présidence de la représentante de la Libye, et elles se sont mal poursuivies. Au cours de six semaines de débats ont été recalées des propositions de texte qui mettaient en cause, en termes modérés, Cuba pour la vague de répression qui vient de s'abattre sur les opposants, la Russie pour les exactions de son armée en Tchétchénie, la Chine, le Soudan et le Zimbabwe pour les pratiques qui y ont cours. Les massacres perpétrés en Côte d'Ivoire n'ont pas été jugés dignes d'une résolution, et il a fallu attendre le discours de clôture de Kofi Annan pour que soient évoqués ceux qui ont eu lieu récemment. Israël a en revanche fait l'objet d'une condamnation désormais rituelle. Enfin la Commission a été incapable d'apporter sa pierre à la reconstruction de l'Irak en formulant des recommandations utiles sur les libertés et la justice.

    Cette commission est devenue une parodie d'elle-même et la majorité des 53 Etats membres se satisfont de cette situation. Au fil des ans, les Etats les moins respectueux des droits de l'homme y sont entrés en nombre toujours croissant ; ils font bloc lors des votes, au gré d'alliances souvent très éclectiques, pour se protéger les uns les autres des mises en cause. Les puissances réputées plus vertueuses ont aussi leur responsabilité dans cette dérive, au sens où les intérêts diplomatiques et stratégiques priment trop souvent sur les considérations relatives aux droits de l'homme. Ainsi les Etats-Unis ont renoncé cette année à faire condamner la Chine. Même si c'est de l'Europe que partent la majorité des initiatives, elle s'est gardée cette année de la moindre critique envers l'Iran pour ne pas compromettre le dialogue engagé avec ce pays.

    La mécanique de la Commission est gravement enrayée. Les ONG, qui savent à quel point cette tribune est précieuse lorsqu'elle fonctionne, appellent les démocraties à se mobiliser pour la remettre d'aplomb. Conscient de cette situation, M. Annan, s'inquiétant d'une dérive qui rend "plus faible" la voix de la Commission, a demandé au haut-commissaire pour les droits de l'homme, Sergio Vieira de Mello, de formaliser d'ici à septembre des propositions de réforme. Cela supposera que des conditions plus fermes soient imposées aux Etats qui veulent siéger à la Commission. Mais cela nécessite aussi, et c'est plus difficile, de restaurer l'idée de l'universalité des principes sur lesquels la Commission est censée veiller, sans autre moyen de sanction que la force morale et politique de ses avis.

    A really bad publicity has been done to the UN for six weeks by the yearly session of the Commitee for Human Rights, which should end Apr 26 in Geneva. The degeneration of this commitee, which is supposed to watch collectively the ways the States respect individual rights and fundamental liberties, becomes more and more clear every year and provides material to all those who want to humiliate the whole UN system.

    Things had poorly started this year, with the saddening help of France, with the sad election of Lybia's representative as President. And the following was equally poor. During the six weeks of debates have been rebuted text projects that moderately accused Cuba for the repression that has recently striked opponents, Russia for its army's cruelties in Chechnya, China, Sudan and Zimbabwe for the practices in use there. The massacres occuring in Ivory Coast weren't deemed worthy of a resolution, and we had to wait for Kofi Annan's closing speech to hear about those which took place recently. Israel has however suffered from a now ritual condemnation. Lastly, the Commitee has been unable to contribute To Iraq's reconstruction by giving useful advice on Freedom and Justice.

    This commitee has become a parody of itself and most of its 53 member states are satisfied with this situation. As years passed, the least respectful States have entered it in growing numbers ; they are tied together during votes, through very surpising alliances, to protect themselves for being criticized. The more "virtous" powers share a responsibility in this disgrace too, as diplomatic and strategical interests are too often predominant over considerations about human rights.
    Thus, the United States have refused this year to have China condemned. Even though Europe is the source of most initiatives, it has carefully avoided this year to criticize Iran any bit in order not to make the dialogue more difficult.

    The commitee's mechanics is troubled. NGOs, who know how precious this stage is when it properly works, call the democracies to mobilize to make it functional again. Mr Annan is aware of such a situation and worries about a degenration which makes "weaker" the message of the commitee. He asked the High Commissioner for the Human Rights, Sergio Vieira de Mello, to elaborate until September reform proposals. This requires more demanding conditions to be imposed to States that want to seat at the Commitee. But it also requires to restore the idea of the universality of the very principles the commitee is supposed to care for, without any other possible sanction than the moral and political power of its opinions. It will be definitely more difficult.

              Is the UN or the countries that are members who suck? I like the idea of a organization of nations, but I don't like the behaviour of the countries inside the UN...

                I often read L'Humanité, but Le Monde has a more convenient website for the news of the day.

                    Well some sort of independent commission from Antartica would surely be better suited to judge the world as an independant observer or maybe a Canadian would suffice

                      Don't worry. I've understand it, and I bet that my English is worse than Gibsie's... And there is always the original French article that can be read with a French dictionary or/and automatic translator

                      [Or, if you speak Portuguese/Italian/Spanish/Rumanian and don't understand some part of the translation, you could try to read the French original. In fact, we all have the Latin as a common ancestor ]

                        I can only hope Annan and some other dedicated people will clean this ****hole well. Of course, the nations that will seat in such a cleaned toilet will taint it rather quickly, but there is always hope it will ramin clean for some time though.

                          Interesting article. Like yaroslav I believe we need some sort of international platform, however, watching like the UN works in reality does indeed suck (often)

                              The UN only has 53 members? I'm sure I heard on the Ali G show that there's more than 100.
