Great game but once i hit modern area the game slows to 3fps from 50-70

gforce 4 4400 newest drivers from nvidia
all antilasing settings turned down to the lowest, graphics
the directx version that came with the game
it doesnt matter if i have all graphics maxed or min i get the same thing.
and the new patch is also installed.
I really hate to return the game because i like it, but it would nice to be able to play a whole skirmish not just up till the modern ages.
so any last suggestions before heading for eb?
