Obviously, it can happen. GMs are only human hence not infallible. In GO1 Duke tried that stunt twice. Once he made it, the next time Jamski noticed and allowed only one class lower ships to be built establishing a precedent. However, Duke's originally built ships stayed, even though he had not enough bases to support ships of that size.
