  • Apolyton Constitutional Convention

    The whole CFC scare has reminded us of one thing: Only when the people rise up and defend their own common interests can a free society be preserved.
    Thus, let us hereby convene to give to ourselves a constitution. I preopose the following:

    I. Preamble

    We the People of Apolyton, in order to form a more beneficial union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the benefits of liberty to all Apolytoners, do ordain and establish this Constitution for Apolyton.

    Furthermore, while We the People of Apolyton recognise that all executive, database maintenance and access control duties are vested within the Administration, We have seen fit to grant the liberty to form for ourselves and for Apolyton any legislative and judicial bodies as they deem necessary to fulfill the above-stated aims of this Constitution.

    II. Resolutions

    1. No bill shall be submitted for a vote before it has been up for Parliamentary debate 72 hours prior to being brought forward for a vote.

    2. All Parliamentary bills shall receive a name, and such name shall be its title.

    3. All poll questions when a bill is brought forward for a vote shall follow the format:

    * "Vote to decide if 'X' passes",

    where 'X' shall be substituted with the full title of the bill brought forward for a vote.

    4. All Parliamentary vote polls shall contain three vote options: YEA, NAY and ABSTAIN.

    5. All Parliamentary vote polls shall last 3 days. The "Run poll for" form shall thus duly be employed.

    6. The Opening Post of any Parliamentary Vote shall contain the full body of the Bill to be voted upon. No more, and no less.

    7. If any bill is brought forward for a vote and has not met the conditions as stated and required in Section II. Paragraphs 1. through 6., the vote will be called off and declared invalid. The vote thread shall be closed by the power of the Prime Minister or the Administrators.

    8. Any bill or vote poll-question that is edited or altered in any way, after it has been submitted for vote, by an administrator, the Prime Minister or any other party, will be declared invalid. Voting is to stop immediately, and the Kourt shall initiate legal action against the offending party.

    III. Elections

    A. Electoral Districts
    1. The forum will be divided into ridings as follows:

    1. Riding of Civilization 4
    2. Riding of Galactic Civilizations/Galactic Civilizations II: Dread Lords
    3. Riding of Civilization 3
    4. Riding of Rise of Nations
    5. Riding of Call to Power 2
    6. Riding of Civilization 2
    7. Riding of Alpha Centauri
    8. Riding of Civilization: Call to Power
    9. Riding of Master of Orion I/II/III
    10. Riding of Alternative Civs
    11. Riding of Hosted Sites
    12. Riding of Miscellaneous

    B. Residency
    1. All citizens of Apolyton are expected to declare their residence in one of the existing ridings.
    2. Citizen who have not declared their residency by the electoral deadline will be considered as residents of the Riding of Civilization 4 for electoral purposes.

    3. All moderators must be residents of the forum over which they hold responsibilities.
    4. Any resident of a riding may run for office in that riding.
    5. Residency may be changed at any time, but for electoral purposes shall be considered fixed between General Elections.

    C. Elections

    1. General Elections must be held every three months, or if Parliament has been dissolved.
    2. The Administration will determine the exact election date and any electoral deadlines. These dates will be published at least 14 days before the vote is to occur.
    3. Any Citizen of Apolyton can run for Parliament. Apolytoners may run under the banner of a Party or on an independent Candidate List in accordance with the principles of Party List Proportional Representation. A Candidate List has no minimum or maximum length.
    4. On election day, one poll will be placed in each riding, with one option per candidate. Each poll will run for 48 hours.
    1. The candidate with the most votes in each poll will represent their riding in the Parliament of Apolyton.
    2. Any ties will be resolved by means of an Administrative ballot.
    5. Additionally, an at-large poll will be placed in the Apolyton/Community Forum, with one option per list. The poll will run for 48 hours.
    1. The electoral formula for the at-large elections is the Sainte-Laguë method, which is implemented as follows.
    2. The votes of the candidate lists are tallied.
    3. Quotients are calculated for each list. The formula for the quotient is V / (2*S + 1). V is the total number of votes the list has received. S is the amount of at-large seats the list has received so far, initially zero.
    4. Whichever list has the highest quotient receives the seat that is being allocated. When a list receives an at-large seat, its quotient is recalculated, since its value of S has changed.
    5. If all the candidates on the list have received a seat, that list is removed from allocation entirely.
    6. This process is repeated until all 13 at-large seats have been allocated.
    7. The Administration, or a designated agent of the Administration, is responsible for calculating the votes and the quotients, allocating the seats and publishing the confirmed results.
    6. The results will be verified by the Administration (or the designated agent of the Administration). Once the results have been verified, the Parliament will be considered elected. Any unclear situations will be resolved by the Administration in a manner it deems fit.
    7. The Administration will publish the verified and confirmed results no more than 48 hours after the polls have closed.
    8. A vote will be considered valid if and only if the identity of the voter can be verified either in the forum of a public posting or a private message to a member or designated agent of the Administration.

    D. By-Elections
    1. By-Elections will be held in the event that one of the seats representing a riding becomes vacant, at the discretion of the Administration.
    2. By-Elections will not be held for vacant at-large seats.
    3. Any resident of the riding for which the by-election is held is eligible to run in the by-election.
    4. The Administration will determine the exact election date and any electoral deadlines. These dates will be published at least 14 days before the vote is to occur.
    5. On the election date, a poll will be placed by the Administration in the riding, with one option per candidate. The poll will run for 48 hours. The results will be verified by the Administration.
    6. The candidate with the most votes will be declared MEP for the riding once the results have been verified.

    IV. Teh Supreme Kourt

    1. Each incoming Parliament is responsible for appointing 3 Judges to sit on The Apolyton Supreme Kourt.
    2. Judges shalle be chosen by parliamentary ballot after each general election.
    3. Vacancies are to be filled as needed by Parliament.
    4. Judges are responsible for resolving all Kourt cases and for moderating the Kourthouse.

    1. No Justice may stand for election to Parliament, but must resign prior to announcing candidacy.
    2. No Justice may be a member of Parliament.
    3. GeoModder is guilty.
    4. Justices may not bring a Kourt case without recusing themselves.
    5. Kourt kases may be brought by any Apolytoner with citizenship.
    6. Non-citizens may be brought to Kourt, but cannot initiate a case.

    5. Parliament reserves the right to alter the nature and/or composition of the Kourt at any time.

    V. Forum Moderation

    1. There shall be exactly 1 elected Moderator per each forum. The Administration may appoint an unlimited number of moderators to any forum.
    2. The responsibilities of the Moderator shall include moderation of his or her forum and promotion of activity within that forum, among all other responsibilities.
    3. Moderators shall be voted upon directly by the people of the applicable riding at 3 month intervals.
    4. In such case where multiple non-administrative forums are a part of the same riding, all citizens of the riding will participate in all elections for forums in that riding.
    5. The Administration may exclude forums from this process as it deems fit.
