Agent Orange was a chemical weapon, a mean of mass destruction (like a nuclear weapons). When you have created it and used it, you know that it is a chemical weapon, just like you know that you bomb Hiroshima and Nagasaki with nuclear bombs. You have tested both weapons on your testing grounds and knew perfectly what the resaults will be.

Ok. Agent Orange didn't kill millions directly, but it helped to kill millions of Vietnameese and was a cause of death and mutations for hell knows how many for generations!
