  • Retired SCotUS Justice Stevens says we should repeal the 2nd Amend.

Sorry "Amendment" wouldn't fit in the title. What do folks think about his argument?

It seems far fetched as only 20% support it and the amendment process is so difficult.

I think he's right. Too bad sanity on murder tools has so little chance - and heinous crap going down from the bad guys wasn't so certain if we start tampering with the Constitution.

On a related note the NRA admits they took a bunch of money from oligarchs close to Putin but claim they didn't launder any of it into its pro-Trump SPAC. Of course, they previously denied taking any money from Russians (much less tens of millions) but it seems Mueller put them into a tight spit so now their story has changed. Will it change again?

The current expansive gun rights are not the only obvious interpretations of the 2nd. So basically the bench just needs to change, right now for many interpretations it is a lot more Republican than the country.

I maintain that this is a dumb sentence and we should repeal the amendment on stylistic grounds alone.

It sure does give gun banners hope for their cause... But the 2nd Amendment to the Bill of Rights contains one right - the people's right to guns. The reason for this right is the Framers opposed standing armies and wanted the states to have militias instead.

Is the right to keep and bear arms the only explicit right?

So, can you ban selling/buying them? I assume there is a court judgement that shows this is covered by the amendment if not explicit somewhere in the constitution?

Yep ... but the big question seems to be whether
                      1. you have to be member of a regulated militia in order to "earn" the right to bear arms
                      2. the right should be restricted to 18th century handheld firearms (which would not allow for any massacres, considering that, with 18th century firearms, you would have to perform a lengthy reloading process after every shot )

The NRA, of course, prefers the most lax interpretation ... no surprise, considering that they are paid by the weapons industry

Especially since this was supposed to replace the need of a standing army. That worked out real well
