Originally posted by Sava View Postmy guess is that that doesn't apply if forces are responding to an attack in self defense
the scenario you describe is if the US forces initiated the attack
that's not what happened
whether the reason for it was a call for support by afghan forces or not doesn´t matter
(the US forces could well have said: Nope, this building is protected .. no air support)
Also the interesting question is, if the afghan forces could have withdrawn from the building complex without losses ...
if they could have done so, it was even m ore so an attack on the building.
(not to forget that it all rests on the claim that there were Taliban in the building ... which is declined by MSF).
IMHO it is only then no war crime, if the US military was too negligient to check the status of the building
(and therefore didn´t know that it was a protected building) ... in which case it would be gross incompetence from those involvedTamsin (Lost Girl): "I am the Harbinger of Death. I arrive on winds of blessed air. Air that you no longer deserve."

With respect, your opinion doesn't matter. Laws do.
The big question is whether the US government and military sees it this way as well.
Considering past incidents (like the iranian flight) I´d assume that all persons involved will get a warning finger while saying, with a smile: "You bad bad boys", directly followed by awarding them all the congressional medal of honor.
(but, of course, past incidents were under republican rule ... maybe the democrats handle incidents like these with a little bit more seriousness)Tamsin (Lost Girl): "I am the Harbinger of Death. I arrive on winds of blessed air. Air that you no longer deserve."

I am sure MSF is going to go with whatever will get them more donations. In the early reports they did not even deny that there were hostile forces attacking from he hospital, only that there were no reports of it."Yay Apoc!!!!!!!" - bipolarbear

but I am sure that, if yours, kids and apocs mindset (that the US military did nothing wrong) is shared by the military command (which I am afraid, it is), that I never will be near military operations of the US military ... not even if I am part of the blue or grey OPFOR ...
and if I am, I hope that I have a couple of MANPADs available, for the case the US military, for one reason or the other, decides to attack my homne or workplaceTamsin (Lost Girl): "I am the Harbinger of Death. I arrive on winds of blessed air. Air that you no longer deserve."

MSF also has a reason to lie for positive publicity in order to get more donations because they need more money due to rises drug prices from the TPP."Yay Apoc!!!!!!!" - bipolarbear
