    Because they wanted to also condemn pornography generally, but not criminalize it.

      This is correct, in the same sense that they also want to discriminate against those who practice incest or bestiality and seek to marry their children or pets. You seem to think the discrimination is wrong when it comes to gays (for some reason), but even if it is morally wrong and bad policy, it could hardly be said it is an act of "big intrusive government." It is a decision by the government to stay out of something it has always stayed out of, a concept that until recently was unheard of: gay marriage.

                  I'm actually almost surprised that the GOP of any state was willing to distinguish between drug-induced abortions and emergency contraceptives which are alleged to prevent implantation (I've heard that the MAP won't actually do that).
