    Compared to no tax at all, yes it is a disincentive. It's not like a health insurance policy has no value at all unless you have the knowledge you will be using it in the near future.

      But with the precondition law, I don't see a reason for you to get insurance until you need it. For above-average health individuals (notably young people who are the ones who typically won't have insurance), the expected utility from insurance is less than the premiums and with a penalty tax substantially less than the premiums, it's conceivable that again the rational action would be to pay the fine and forgo insurance.

        Yes, it's conceivable. I think we can be confident that when they decided on a fine, they thought about the possibility of people choosing to pay it.

        • Watching how some Republicans have turned on Justice Roberts has been almost scary. I mean, I've never been a fan of the guy by any means but some folks are acting like he just screwed their wife and shot their pet dog.

          • The tax is constitutional. Roberts was doing his job. Policy is not his responsibility and this law makes bad policy, even if it is legal.

                • It's also been funny seeing conservatives declare they'll move to Canada because of the evil health insurance which will cover them when they are sick. I guess they haven't heard Canada has the truly evil universal health insurance.
