The Ragin' Cajun is one of the biggest partisans there is. He was on the Clinton campaign staff and he will eat a suicide pill before he says something that could be construed as negative about the Democratic Party. A few points:

In the 1790's the Congress required shipping companies to carry insurance on all their ships, employees, and cargo. This was upheld by the Supreme Court.

President John Adams legally required all sailors and seamen to buy hospitalization insurance for themselves. This was also upheld by the Supreme Court.

And, of course, we still have George Washington's requirement that virtually all adult white males buy a fire arm, ammo, and military gear. Definitely upheld by the Supreme Court.

Frankly, anyone claiming there is some sort of constitutional violation here is a liar, an idiot, or a partisan political actor (which makes them a liar but I repeat myself).

I'd also bet that these wingnuts who think "judicial review" is so valuable don't know that it didn't even exist in the 1790s!

Of course he's partisan, but he's also a very sharp political mind, and it really doesn't take someone of Carvilles stature to work out how this could be used to help the Democrats in November. The Democrats are (barring disasters) going to comfortably hold the White House anyway, but with a common cause to rally around (single payer sound like a plan?) they can revitalize the base. Oh and given that the mandate has been the cornerstone of Republican healthcare policy for decades, what exactly do the GOP have to hold up as an alternative? Voucher schemes?

Obamacare was a cluster**** that most Dems hated but felt they had to stand up for because it at least got some uninsured people insured. If it falls then all the people who thought they were about to have their lives improved are not going to take it lightly. Single payer is going to be on an awful lot of lips if the court goes crazy and dumps this.

Even funnier is his suggestion that single payer is right around the corner. I seem to recall that crashing and burning in a filibuster-proof majority. Now suddenly they're gonna peddle it for 2012?

1. Mr. Obama does not face a major problem with his base, but his standing is tenuous with swing voters.
2. Among swing voters, the health care bill is not very popular.
3. The Supreme Court declaring the health care bill unconstitutional will not make it more popular among swing voters.

When people are asked about Obamacare, most are negative. When people are asked about individual sections of the bill, the response is extremely favourable. Single payer is also a much more attractive proposition to this crappy bill. Ergo..

In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president's bluff -- ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.

The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president's comments yesterday about the Supreme Court's review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was "confident" the Court would not "take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress."

Overturning a law of course would not be unprecedented -- since the Supreme Court since 1803 has asserted the power to strike down laws it interprets as unconstitutional. The three-judge appellate court appears to be asking the administration to admit that basic premise -- despite the president's remarks that implied the contrary.

I think Nate Silver is a lot savvier at American politics than you are...but if you aren't convinced, then realize that Nate Silver's advantage over virtually everyone else in the business is that he actually takes the time to back up his analysis with quantitative evidence.
