If the PD is so inflexible that it creates a situation where a captain would willingly stand aside rather than save people from being killed when he can easily do so, then it's fatally flawed.

But the thing is, Kirk violated the PD several times without repercussion. So apparently the precedent had already been set that when in situations where a captain is faced with impending atrocities, breaking the PD was tolerated. That just makes Picard's weak-kneed refusal to break it to save innocent lives all the more appalling.
