yes, by ignoring umemployed people you're cutting yourself off from a massive pool of talent.

Obivously not a problem for them or they A) wouldn't do it. or B) would promptly go out of business.

Why not pass legislation that would protect unemployed people from employment discrimination?

This seems likely to happen, but it will not prevent such discrimination, and the government really doesn't have the will to enforce it.
