Asher, it's a state law, not a federal law. The federal government has no jurisdiction over this stuff.

That said it would probably get struck down by the supreme court if it ever got that far.

Serious explanation? At some point, Mass. was concerned with order and morality in the schoolyard. Then this offence was introduced. Now it's either a historical relic kept around by legislative apathy or a reflection of current moral standards in Mass.
