  • Swiss warn UBS bank could collapse

I actually have a friend who works for UBS after graduating with his MBA from Northwestern last summer. He certainly won't like this news. UBS is a giant both in Switzerland and in the US. It's facing massive tax fraud charges in the US for helping rich Americans hide their assets from the IRS in Swiss bank accounts and to reduce the fines they've promised to hand over the American tax cheats to the IRS but now a Swiss court has said they can't do that. This will mean UBS will not get reduced sentences and it will likely be forced to pay massive fines and have its license in the US revoked which would mean the company will go bust.

Swiss warn UBS bank could collapse

Switzerland's justice minister warned in an interview on Sunday that top bank UBS could collapse if sensitive talks with the United States over a high-profile tax fraud investigation fall through.

"The actions of UBS in the United States are very problematic. Not just because they are punishable but also because they threaten all of the bank's activities," Eveline Widmer-Schlumpf told Le Matin Dimanche newspaper.

"The Swiss economy and the job market would suffer on a major scale if UBS fails as a result of its licence being revoked in the United States," she said.

Switzerland and the United States have negotiated an agreement under which UBS would hand over information on some 4,500 account holders to US tax police.

But a Swiss court ruling earlier this month put the deal in doubt.

Many in Switzerland, where banking secrecy is a source of pride and a key part of the economy, have accused the government of failing to protect UBS.

"We have nothing to blame ourselves for. I don't think anyone could prove that we acted badly," Widmer-Schlumpf said in the interview.

That's massive in Switzerland. If other banks follow suite then the Swiss will be left only with their cheese. I feel bad for my family there, it will ripple through the whole economy.

This is wrong. I've always wanted to be rich enough to need a Swiss bank account, and now I won't be able to.

Not cuckoo clocks. Cuckoo clocks are from the Black Forest.

Can't UBS tell "**** you" to the IRS and simply pull out of the US? It's not like they can fine a Swiss company, or can they?

Precision watches, cuckoo clocks, fine cheese, chocolate, banking: Switzerland is well known for all of these.

I find it amazing that UBS thought it could run a US bank and still keep its closely-guarded secrecy intact. All of these problems seemed foreseeable as soon as SBC bought Dillon Read and confirmed when UBS bought PaineWebber.
I came upon a barroom full of bad Salon pictures in which men with hats on the backs of their heads were wolfing food from a counter. It was the institution of the "free lunch" I had struck. You paid for a drink and got as much as you wanted to eat. For something less than a rupee a day a man can feed himself sumptuously in San Francisco, even though he be a bankrupt. To be clear, UBS isn't alone in its blindness. Credit Suisse also seems to have believed it could have a substantial US bank while keeping its secrecy intact.

Is there any evidence of wrongdoing by the UBS account holders the IRS is after?

They could but their assets would be frozen and prevented from leaving the country until they paid the fines for helping people commit tax fraud. Also the US operations are something like 50% of their business so it would mean losing half of their business at a time when the company is holding on by its finger nails so it would likely go bust. The lesson here is the IRS will get its money so it is best not to break the law.
