There was this guy on "The Shark Tank" the other night who had a device that wouldn't allow your car to start if you weren't buckled. He wouldn't sell it to the VCs because he wanted guarantees that the item would actually be marketed and sold to the consumers if not just the car companies. I think our money would be well spent buying patents (even for large sums) if they would be made free to the public. There is a lot of IP that is bought and never used to protect existing IP, much to the determent of society.
Of course, design patents would become huge, but that really has little to do with functionality or even utility.
